THE COURT OF APPEAL HAS HANDED DOWN A DECISION
CONCERNING REPUDIATION OF CONTRACTS
Quest Advisors Ltd v McFeely
The Court of Appeal handed down its decision in Quest Advisors
Ltd v McFeely [2011] EWCA Civ 1517, a case concerning the sale and
leaseback of a development site. The Court considered the
lawfulness of two decisions made in relation to the construction of
a Court order. The Court found that there had not been a
repudiation of contract, and requiring one party to pay a lump sum
in respect of money owed thereunder.
